Accusing it of inaction, blatant disregard of court orders and insensitivity, the L-G Secretariat alleged the AAP government had been sitting on a trial court order to appoint senior public prosecutors and public prosecutors for speedy disposal of 20 POCSO cases in different city CBI courts for the past nine months.
Alleging that the file related to the decision had been doing rounds from Chief Minister to different ministers since January 11, and was currently pending with CM Arvind Kejriwal for the last 25 days, officials said L-G VK Saxena, “constrained by this inaction and unexplained delay”, approved Home Department’s proposal related to their appointment.
The government accused the L-G of having issued the “illegal” orders behind its back, and said these would be challenged in the Supreme Court. “Neither the minister nor CM was taken into confidence by L-G. We are surprised that despite facing strong reprimand from the SC repeatedly, L-G has issued orders without jurisdiction,” the government stated.
According to L-G House officials, Home Department’s proposal involved invoking the power of the central government u/s 24(8) of CrPC and sending it for the issue of notification for appointment of senior prosecutors to Ministry of Home Affairs. “The file… was moved by Home Department following a direction to this effect by a trial court, and subsequent letters by CBI, to ensure the same in August and December 2022,” L-G House officials said.
The L-G Secretariat said the file first reached the Delhi Home Minister on January 11 and the CM on January 16, who marked it to the minister-in-charge on February 6. After reaching the Law Minister “through an unspecified date” in file monitoring system, it was submitted to the CM on May 8, since when it was “lying unaddressed”, L-G House officials alleged.
A Raj Niwas official alleged: “Even as the CM and his ministers unabashedly politicise incidents of crime and speak about the absence of fear of law amongst criminals, when it came to practice, they did not comply with basic requirements of investigation and justice delivery system.”

The AAP government retaliated by accusing Saxena of interfering with the work of the government. “The people of Delhi are fed up with this L-G, who, rather than doing his own job of maintaining law and order, is repeatedly interfering in working of the elected government… When the women of Delhi are feeling unsafe and facing assaults, L-G should be devoting his energies to providing safety to the people of Delhi,” the government stated.
Kejriwal tweeted: “The women of Delhi are feeling very unsafe… Their appeal to LG saab is – LG saab, quit politics, do something.”
Meanwhile, Delhi BJP president Virendra Sachdeva accused the Delhi government of only talking big on women’s safety but doing “little work” to get speedy justice for victims. “Despite the efforts of the Delhi Police, these cases are not disposed of in a timely manner due to lack of public prosecutors,” Sachdeva alleged.
